GUEST TERMS & CONDITIONS

(Legally Binding Agreement)

By confirming a reservation, completing payment, or checking in, the Guest agrees to the following terms.

1. Legal Entity & Acceptance

Le1226 is operated by 12424177 CANADA INC, a corporation registered in Canada.

By clicking “Confirm Reservation,” making payment, or occupying the property, the Guest:

  • Confirms they are legally capable of entering a binding agreement
  • Accepts these Terms & Conditions in full
  • Agrees to comply with all house rules

Electronic acceptance constitutes a legally binding contract under Canadian electronic commerce legislation.

2. Reservations & Payments

2.1 Full payment or approved deposit is required at the time of booking.

2.2 Accepted payment methods may include:

  • Visa / Mastercard / American Express
  • Interac e-Transfer (Canada)
  • PayPal
  • Stripe
  • Other approved processors

2.3 The reservation name must match:

  • Government-issued ID
  • Payment method holder

2.4 Fraudulent, disputed, or unauthorized transactions may result in:

  • Immediate cancellation
  • Refusal of check-in
  • Reporting to financial institutions

3. Identity Verification Policy

3.1 Government-issued photo ID is required for direct bookings before check-in.

3.2 Le1226 reserves the right to:

  • Refuse entry if ID is not provided
  • Cancel without refund if identity cannot be verified

3.3 ID records may be securely retained for fraud prevention and dispute defense in accordance with Canadian privacy laws.


4. Strict Cancellation & No-Refund Policy

4.1 All reservations are non-refundable unless:

  • A written cancellation policy explicitly provides otherwise
  • Required under applicable New Brunswick or Canadian consumer law

4.2 No refunds will be granted for:

  • Early departure
  • No-show
  • Transportation delays
  • Weather conditions
  • Change of plans
  • Personal emergencies
  • Visa denial
  • Dissatisfaction not reported during stay

4.3 Guests are strongly advised to purchase travel insurance.


5. Chargebacks & Payment Disputes

5.1 By completing payment, Guest acknowledges:

  • Accommodation inventory is time-sensitive and cannot be resold after check-in date.

5.2 In the event of a chargeback, PayPal claim, or Stripe dispute, Le1226 may submit:

  • Booking confirmation
  • Signed digital acceptance
  • Government ID verification
  • IP address logs
  • Timestamp records
  • Communication records
  • Check-in documentation
  • Property surveillance records (where lawful)
  • Before/after condition photos

5.3 Filing an unjustified chargeback after using the accommodation constitutes breach of contract and may result in:

  • Debt recovery action
  • Collection proceedings
  • Legal claim
  • Ban from future bookings

6. Check-in & Check-out

6.1 Check-in and check-out times must be respected.

6.2 Late checkout without approval may incur:

  • Additional hourly charges
  • Full daily rate

6.3 Unauthorized occupancy beyond checkout time may result in an immediate charge to the payment method on file.


7. Security Deposit & Financial Responsibility

7.1 Le1226 may:

  • Hold a refundable security deposit
  • Pre-authorize a payment method

7.2 Guests are financially responsible for:

  • Property damage
  • Missing items
  • Excessive cleaning
  • House rule violations
  • Lockouts or lost keys

7.3 Damage claims may be processed up to 14 days after checkout.


8. House Rule Violation Fee Schedule

The following fees are agreed upon at booking:

  • Smoking inside property: $250 minimum
  • Lost key or lockout service: $45 per occurrence
  • Deep cleaning (biohazard, excessive mess): $150 minimum
  • Unauthorized guest: $100 per night per person
  • Damage to property: Repair or replacement cost plus administrative fee

These fees represent reasonable pre-estimated damages and administrative costs.

Charges may be applied to:

  • Security deposit
  • Payment method on file
  • Formal invoice collection

9. Property Rules & Conduct

9.1 No smoking indoors.

9.2 No parties, commercial filming, or events without written approval.

9.3 Quiet hours must be respected.

9.4 Only registered guests are permitted.

9.5 Illegal activity results in immediate eviction without refund.


10. Right to Refuse Service

Le1226 reserves the right to deny or terminate service without refund in cases including:

  • Intoxication or drug impairment
  • Violent, abusive, or threatening behaviour
  • Fraudulent booking or payment
  • Violation of house rules
  • Illegal activity

Removal may involve law enforcement if necessary.


11. Shared Space Disclaimer (If Applicable)

Guests acknowledge that some facilities may be shared.

No refund will be issued for inconvenience caused by other guests unless management fails to act on documented violations.


12. Photo & Evidence Documentation Policy

12.1 Le1226 documents property condition:

  • Before check-in
  • After checkout

12.2 Documentation may include:

  • Time-stamped photos
  • Video recordings
  • Cleaning logs
  • Inventory reports

12.3 These records may be used for:

  • Stripe dispute defense
  • PayPal claims
  • Credit card chargeback arbitration
  • Insurance claims
  • Legal proceedings

Guests consent to this documentation for legitimate business protection.


13. Surveillance Disclosure

Security cameras may be installed in exterior and common areas only, in compliance with Canadian privacy laws.

No cameras are installed in private spaces (bedrooms, bathrooms).


14. Cleaning & Maintenance Reporting

14.1 Rooms are cleaned before arrival.

14.2 Maintenance issues must be reported immediately during the stay.

Failure to report issues during stay voids eligibility for refund or compensation claims.


15. Force Majeure

Le1226 shall not be liable for service disruption caused by:

  • Natural disasters
  • Government restrictions
  • Public health events
  • Utility outages are beyond control
  • Acts of God

No refund shall be due unless legally required.


16. Limitation of Liability

Guests use the premises at their own risk.

Le1226 and 12424177 CANADA INC are not liable for:

  • Loss of personal belongings
  • Injury caused by guest's negligence
  • Third-party service interruption
  • Parking incidents

Guests agree to indemnify the company against claims resulting from their conduct.


17. Dispute Resolution & Arbitration

17.1 Disputes must be submitted in writing within 7 days of checkout.

17.2 Parties agree to attempt mediation before litigation.

17.3 Where legally permissible, disputes shall be resolved by binding arbitration in New Brunswick.


18. Privacy & Data Protection

Personal data is collected solely for:

  • Reservation processing
  • Legal compliance
  • Fraud prevention
  • Security purposes

Information may be shared with payment processors or authorities when legally required.


19. Governing Law

This Agreement is governed by the laws of:

Province of New Brunswick, Canada.

All disputes are subject to the jurisdiction of the New Brunswick courts unless arbitration applies.
